El Nuevo Reglamento de Sanidad Vegetal (Reglamento (UE) 2016/2031) reemplaza y deroga a la Directiva 2000/29/CE, además de siete Directivas de Control sobre plagas. Tiene como objetivo superar las dificultades planteadas en el anterior régimen fitosanitario de la Unión Europea y poner en marcha un nuevo marco normativo fuerte, transparente y sostenible.
Da un paso adelante en la transparencia y refuerzo de la base científica, y califica las plagas con arreglo a cuatro categorías (prioritarias, cuarentenarias de la Unión, cuarentenarias para zonas protegidas y reguladas no cuarentenarias). Unifica la legislación fitosanitaria integrando todos los ámbitos de aplicación: agricultura, forestal, medio ambiente y paisajístico, lo que supone un avance en la sostenibilidad. Es, por tanto, una legislación pensada para adaptarse con agilidad a los nuevos riesgos emergentes.
El nuevo régimen se compone además de legislación terciaria, de la que hay aprobados nueve reglamentos de ejecución y tres delegados, y adicionalmente de las medidas de emergencia.
In order to evaluate the application of the regulations on the sustainable use of plant protection products, it is necessary to have harmonized indicators that make it possible to measure and quantify the main objective of reducing risks. These harmonized risk indicators have been defined by Directive 2019/782. The incorporation into the Spanish legal system has been carried out through Royal Decree 555/2019, of September 27, which modifies Royal Decree 1311/2012, of September 14, which establishes the framework of action to achieve sustainable use of phytosanitary products.
On the other hand, taking into account the legislative framework of the European Union and Spain applicable to the evaluation and sustainable use of pesticides, by means of Royal Decree 285/2021, of April 20, some existing national provisions regarding storage and tests and experiences with plant protection products; Likewise, it was necessary to legislate on certain activities related to commercialization, creating the electronic record of transactions and operations with plant protection products (RETO), and with the use of plant protection products in order to improve market transparency and guarantee their traceability and correct use.
